Terms of Service

The agreement that governs your use of Publica.la Plus.

These Terms of Service (“Terms”) govern your access to and use of Publica.la Plus (the “Service”), operated by publica.la. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Acceptance of these terms

By registering for, accessing or using Publica.la Plus, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

The Service

Publica.la Plus is a service platform for the publishing industry. It provides tools to validate, fix and enrich EPUB and other files, check accessibility, extract metadata, convert formats and create content with the help of AI. The available tools evolve over time; we may add, change or remove tools as the platform grows.

Accounts and eligibility

You must provide accurate registration details and keep them up to date. You are responsible for safeguarding your credentials and for all activity under your account.

publica.la customers with an active store may receive a workspace and preferential pricing as described on our pricing page.

Plans, subscriptions and billing

Publica.la Plus is offered under subscription plans (Starter, Pro and Max). Paid plans are billed in advance on a recurring basis through our payment processor, Stripe.

The Starter plan includes a 30-day free trial; AI credits cannot be spent during the trial. You can upgrade, downgrade or cancel your subscription at any time, and changes take effect according to your billing cycle. Fees already paid are non-refundable except where required by law.

AI credits

Each plan includes a monthly allotment of AI credits. Running a tool spends credits according to how much work it requires.

  • Credits are consumed only when you choose to run a tool.
  • Monthly credits reset each billing cycle and, unless stated otherwise, do not roll over.
  • You can top up additional credits at any time.
  • Credits have no cash value, are not transferable and are not redeemable for money.

Acceptable use

You agree to use the Service lawfully and responsibly. You must not:

  • Upload content you do not own or are not authorized to process.
  • Use the Service to create or distribute illegal, infringing or harmful content.
  • Attempt to disrupt, reverse-engineer or gain unauthorized access to the Service or its infrastructure.
  • Resell or provide the Service to third parties except as expressly permitted.
  • Use the Service to violate the intellectual property or privacy rights of others.

Your content

You retain all rights to the files and content you upload (“Your Content”). You grant us a limited licence to process Your Content solely to operate the tools you run and deliver the results back to you.

You are solely responsible for Your Content and for ensuring you have the necessary rights to upload and process it.

AI features and outputs

AI tools run only when you start them. Outputs are working drafts generated to assist your publishing work; you are responsible for reviewing them before use. Given the nature of AI, outputs may contain inaccuracies and are provided without warranty of correctness.

Your content is not used to train AI models, and AI outputs are not stored or redistributed by Publica.la Plus. See our AI transparency & policy and Privacy Policy for detail.

Intellectual property

The Service, including its software, design, trademarks and content (excluding Your Content and the AI outputs delivered to you), is owned by publica.la and its licensors and is protected by intellectual property laws. These Terms do not grant you any right in our intellectual property beyond the right to use the Service.

Third-party services

The Service relies on third-party providers, including AI providers, payment processing and cloud infrastructure, as described in our Privacy Policy. Your use of the Service may be subject to those providers’ terms, and we are not responsible for their acts or omissions beyond our contractual arrangements with them.

Availability and changes

We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue parts of the Service, and we may perform maintenance that temporarily limits availability.

Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability and non-infringement, to the maximum extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, publica.la will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, revenue or profits, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim arose.

Indemnification

You agree to indemnify and hold harmless publica.la from any claims, damages or expenses arising from Your Content or from your breach of these Terms or of applicable law.

Term and termination

These Terms apply while you use the Service. You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to others or to the platform. On termination, your right to use the Service ends, and the provisions that by their nature should survive will continue to apply.

Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws applicable to publica.la’s place of establishment, without regard to conflict-of-law rules. Any dispute will be subject to the competent courts of that jurisdiction, unless mandatory consumer-protection law grants you other rights.
